No Purchase or payment of any kind is necessary to enter or win this Sweepstakes.  A purchase or payment will not increase your chances of winning.  This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Instagram or Facebook.  Any information provided is being provided to the Sponsor and not Instagram or Facebook.

These Official Rules govern the Etcetera Spring Giveaway (the “Sweepstakes”) offered by Carisle Etcetera LLC. (“Sponsor”).  These Official Rules are a legally binding agreement between Sponsor and the person entering the Sweepstakes (“you” or “entrant.”) Please do not enter if you do not agree to these Official Rules without modification.

Please read these Official Rules carefully as they affect your legal rights, including your right to sue.

Eligibility:  Sweepstakes is open to legal residents of the United States (including the District of Columbia) who are 18 years of age or older as of the date of entry, except employees of Sponsor and its affiliates, subsidiaries, advertising and promotion agencies and the immediate family members and/or those living in the same household of each such employee.  Sweepstakes is void where prohibited by law.

Personal Information:  We will treat all personal information we receive from entrants, including e-mail addresses, in accordance with our privacy policy at https://www.etcetera.com/privacy-policy/. However, by entering the Sweepstakes, you agree that we may also (a) disclose your first name, last name, hometown and state of residence to the public in connection with this Sweepstakes; and (b) to the extent required to comply with laws, including the requirement to provide a list of winners.

Sweepstakes Period: Sweepstakes begins at 12:01 a.m. Eastern Time (ET) on February 26th, 2021 and ends at 11:59 p.m. ET on March 3, 2021 (the “Sweepstakes Period”). 

How to enter: To enter the Sweepstakes, entrant first needs to have the free Instagram application downloaded on their mobile device and to become a registered user.  Before entering the Sweepstakes, the “Photos Are Private” option in the account settings on your Instagram account must be set to “OFF.”  To enter the Sweepstakes, entrant must (1) follow the Etcetera account (@EtceteraNYC); (2) comment on the image posted by Sponsor (the “Sweepstakes Image”) during the Sweepstakes Period; (3) tag one (1) friend only within the comment ; and (4) like the image.  For clarity, only entrant will be entered into the Sweepstakes, not the tagged friend. All entries must comply with these Official Rules, including, without limitation, the “Entry Requirements” section below. All entries must be submitted during the Sweepstakes Period. Entries will not be acknowledged or returned. 

In the event of a dispute over the identity of any potential winner, the entry will be declared made by the authorized account holder of the account used for entry, and potential winner may be required to provide identification sufficient to show that he/she is the authorized account holder. It is the sole responsibility of the entrant to notify the Sponsor in writing if the entrant changes his or her email or postal address during the Sweepstakes Period. Proof of uploading an entry does not constitute proof of delivery or entry. All entries become the property of Sponsor and will not be returned to entrant.

Entry Requirements: To be eligible, entry must: (1) be in keeping with Sponsor’s image; (2) may not be obscene, indecent, or otherwise offensive (as determined by Sponsor in its sole discretion); (3) not defame or invade the publicity or privacy rights of any person, living or deceased; (4) infringe, violate, or misappropriate any person’s or entity’s personal or proprietary rights (including copyrights, trademarks, or other intellectual property rights); (5) not contain (i) any words, statements, or images considered offensive to individuals of any age, race, ethnicity, national origin, religion, sexual orientation, or other protected class, or who are disabled, (ii) any threats to any person, place, business, group, or entity, (iii) materials that promote bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on age, race, ethnicity, national origin, religion, sexual orientation or other protected class, or disability, (iv) any materials that depict illegal acts, are sexually explicit, libelous, obscene, violent, hateful, slanderous, (v) content not in keeping with Sponsor’s reputation and image or (6) adhere to the Instagram Terms of Use set forth here http://instagram.com/about/legal/terms/ and (7) not be owned by a third-party and/or be subject of or to any restriction or right that would in any way limit Sponsor’s right to use the entry as permitted under these Official Rules (collectively “Entry Requirements”). Failure to comply with these Entry Requirements, as determined by Sponsor in its sole discretion, is grounds for an automatic disqualification from the Sweepstakes.

Limit: You may enter as many times as you wish during the Sweepstakes Period.  Entries generated by a script, computer programs, macro, programmed, robotic or other automated means are void and will be disqualified.  Entries that are incomplete, corrupted, forged, late or otherwise not in compliance with the Official Rules will be disqualified from the Sweepstakes, at Sponsor’s sole and absolute discretion.   

Drawing: Three (3) potential winners will be selected in a random drawing on or about March, 2^nd 2021 from all eligible entries received.  All decisions of the judges are final.  Odds of winning will be determined by the number of eligible entries received.  Prize consists of only those items specifically described as included in the prize.  All fees, federal, state and other taxes, costs and expenses relating to the use, acceptance and possession of the prize are the sole responsibility of the winner.

Prize:  Each Winner (3) will receive one $500 virtual gift card or voucher each, redeemable only on Etcetera.com. Approximate Retail Value (ARV): $500.00.  

Additional Prize Conditions.  Redemption, receipt and other use of the prize may be subject to additional terms and conditions listed on the prize itself or its packaging, including any cover email.

Notification:  Sponsor will announce the potential winners March 4^th, 2021 via a post on the Etcetera Instagram account with instructions and a time frame for the potential winner to contact Sponsor to begin the process of eligibility verification prior to prize claim. All instructions provided by Sponsor must be correctly followed and completed within the time period indicated in such notification.  Noncompliance within any of the time periods will result in disqualification without further notice and an alternate winner will be selected.  Such instructions will require the potential winner to correspond with Sponsor via the email address provided. ALL ENTRANTS ARE ADVISED TO MONITOR THEIR INSTAGRAM ACCOUNTS ON THE DRAWING DATE AND REGULARLY THEREAFTER IN ORDER TO RECEIVE NOTICES TIMELY. SPONSOR WILL NOT BE RESPONSIBLE FOR ANY POTENTIAL WINNER’S FAILURE TO RESPOND WITHIN THE REQUISITE TIMEFRAME.  Upon prize forfeiture, no payment or other compensation will be made to the original potential winner.  As part of the eligibility verification and prize award process, the potential winner must sign and return an affidavit of eligibility and liability release, if provided by Sponsor, within seven (7) days of receipt thereof from Sponsor or an alternate potential winner may be selected.  In the event that a potential winner is disqualified for any reason, Sponsor will award the prize to an alternate winner by random drawing from among all remaining entries.  There will be three (3) alternate drawings. After the third such drawing, the prize will remain unawarded.  In the event of noncompliance with any requirement, the non-complying potential winner will be disqualified.  No substitution, exchange or transfer of prize except by Sponsor, in which case a prize of equal or greater value will be substituted.  

Release:  By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor, including the interpretation of these Official Rules and its exercise of discretion, which will be final and binding in all respects.  Entrants are solely responsible for their own actions and agree to fully and forever release and hold harmless Sponsor, Instagram and their respective  parent, subsidiaries, divisions and related companies, together with and the respective officers, directors, employees, agents, successors, assigns and licensees of each of them, and those companies supplying prizes (collectively the “Released Parties”) from any claims, causes of action, liabilities, losses, damages, including injuries, costs and expenses (together, “Claims”)  caused by, arising in connection with or incidental to their participation in the Sweepstakes or the award or use of a prize. Entrants further agree to fully and forever waive all such Claims they may have or that may arise against the Release Parties caused by, arising in connection with,  or incidental to their participation in the Sweepstakes or the award or use of a prize, whether known or unknown and whether foreseeable or unforeseeable, each at the time the waiver is made, and all of the foregoing including such Claims arising out of the Released Parties’ negligence.

For residents of California: Residents of California explicitly agree to waive the protections to which they may be entitled under California Civil Code Section 1542, which reads:

A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.    

General Conditions:  Sponsor, Instagram, and each of their affiliates, subsidiaries, parent corporations, and their respective officers, directors, shareholders, employees and agents, are not responsible for any incorrect or inaccurate entry information, theft, tampering, destruction, or unauthorized access to, or alteration of entries; any error, omission, interruption, defect or delay in operation or transmission of any Sweepstakes-related website; failure of any entry to be received by Sponsor due to technical  problems or human error; printing or other errors.  Sponsor reserves the right to modify, suspend or terminate the Sweepstakes in the event of fraud or if it becomes necessary due to circumstances beyond Sponsor’s control.  In the event the Sweepstakes is terminated early, a potential winner will be selected from all eligible entries received at the time of termination.  

Disputes:   The Sweepstakes is governed by the laws of the United States and, by entering, entrants hereby submit to the jurisdiction and venue of the federal, state and local courts located in New York, New York.  ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE RELATED TO SPONSOR OR THE SWEEPSTAKES OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW
